Terms and Conditions

Art. 1: General

(1) The following terms and conditions shall govern the sale by Accent Group Sagl.  (named “us”) and the buyer or webpage visitor (named “you”). Accent Designs Sagl is a Limited Company registered in Switzerland and is the owner of the brand name Accent Designs. Any terms and conditions that you propose or object to are subject to our written consent. By placing an order with us, it is deemed that you have read, understood and agreed to our Terms and Conditions. If you are unhappy with any aspect of our terms and conditions, please contact us before placing an order.

(2) We reserve the right to add, delete or amend these Terms and Conditions without prior written notice at any time, at our sole discretion.

(3) Our offices are open from Monday to Friday from 10:00 am to 5:00 pm (Swiss time).

Art. 2: Content and Use of this Webpage

(1) We try to ensure that the information on this site is accurate and complete. We do not warrant or represent that the webpage’s content is accurate, error-free or reliable. Your use of the webpage is at your risk. We do not warrant that the functional aspects of the webpage will be error free.

(2) This webpage is for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any software, products, or services contained within this webpage. You may not use this webpage, or any of its content, for any commercial purpose, including any advertising or advertising revenue generation activity on your own webpage.

Art. 3: Contract

(1) Orders are only possible via our brand’s Accent Designs website (www.accentdesigns.ch). As soon as you have filled in the order form and confirmed your order with the “ORDER NOW” and the "PAY NOW" buttons, a contract between you and us is established in accordance with the conditions below (in this TERMS AND CONDITIONS document) without written notice from us.

(2) The placed order and chosen conditions are representative for the delivery of our products. The prices and conditions shown at the time you placed the order and confirmed with “PAY NOW” apply.

(3) These conditions are made for orders of usual commercial volume. If you wish to place an order of a higher volume, please contact us first.

Art. 4: Presentation of Products

(1) Please note that while we have tried to accurately display the colors of products, the actual colors you see will depend on your monitor and may not be accurate. If you should have a problem, question or concern, please contact us immediately.

(2) Furthermore please note that some of our products are made of recycled and/or raw material. Some corresponding inequalities of material and color are possible.

Art. 5: Prices and Payment

(1) All prices are retail prices in Swiss francs, Euro, British Pound and US Dollar.

(2) Accepted method of payment is Paypal. Please visit www.paypal.ch for more information.

(3) The total cost of your items ordered plus shipping fees as displayed on the web will
be billed to your credit card.

(4) This does not include any taxes, duties, import fees or customs fees charged by your local government. As customs policies vary widely by country, we cannot anticipate what these charges will be and are not responsible for any taxes, duties, import fees or customs fees levied once the merchandise reaches your country. Please contact your local government or post office for more information.

Art. 6: Delivery

(1) All orders will be processed within 72 hours from the date of order at the shown prices and delivery conditions to the given address. We will try our best to process orders we receive by 12:00 (Swiss time) to send them out the same date. Delivery dates are without obligation. For binding delivery dates a written guarantee is necessary.

(2) Delivery is made at your risk and expense. Additional cost may result in the case of delivery to foreign countries.

(3) We reserve the right to refuse orders.

(4) We cannot arrange for goods to be left with a neighbor or similar requests.

(5) All deliveries to other countries may be subject to taxes, duties, import fees and custom fees as mentioned in Art 5: Prices and Payment. If you are unsure if this appeals to you, please contact us. For more precise information about the costs involved please contact your local government or your post office.

(6) The advised dates of delivery may change because of events beyond our control.

(7) For countries that are not displayed on the country list delivery cannot be guaranteed. For further information, feel free to contact us.

(8) If a parcel is returned, because the address was incomplete or incorrect, because you refused to accept it or because you didn't pick it up at your post office in time, you will be charged for the shipping costs back to Accent Group Sagl.

(9) All shipping and delivery is performed with UPS.

Art. 7: Return Policy

(1) Your satisfaction is guaranteed 100%. We gladly accept returns for any reason within 30 days from shipping date. Shipping charges are not reimbursed.

(2) Please return the product to the address displayed on the delivery note.

(3) We will control all returned products. All goods must be returned in perfect condition along with a copy of your initial Accent Group Sagl invoice/delivery note with its original package without signs of usage. You have to pay the postal fees for this kind of return. We will dismiss the returned product if:
- The product shows signs of visible use
- The product returns without original packaging and/or product tags
- The product is damaged as a result of return transport

We reimburse your payment (Duties, taxes and other expenses excluded). In case of return, you will be charged for all shipping charges.

(4) If the product is in any way faulty or does not conform to the order placed, we will gladly refund the purchase price paid, the return shipping cost; any customs, duties and goods taxes (upon proof of payment i.e. a receipt), plus the original shipping costs. Likewise, no good will be taken back if it shows signs of damage or interference, such as
- Natural wear and tear
- Events out of our control e.g. natural disasters
- Signs of improper use
- Interference by the customer or a third person
- Extreme use or extreme influence by the customer

The items can be sent to address displayed on the delivery note.

All refunds will be issued based upon the original form of payment (Paypal).

(5) No cost will be covered should the product/s go missing during the return shipping. We advise you to send all items back with a transport firm which provides a track & trace service.

Art. 8: Our right

(1) If you supplied us with incorrect information about your creditworthiness we reserve the right to withdraw from the contract in whole or in part.

(2) We reserve the right to refuse orders.

Art. 9: Reservation of proprietary rights

The goods shall remain our property until you have fully paid any and all debts as of the contracting date, including the current account balance if any.

Art. 10: Warranty and Replacement

(1) In the case of a material defect in the product on our behalf, you have the right to choose a similar product in exchange, to withdraw from the contract or to request a price reduction within 3 months from the purchase date. All requests are to be confirmed by written correspondence with us.

(2) It is up to you to control the products either upon delivery and to notify us within 3 months. Failure to do so will result in a loss of your rights.

(3) Other claims for damages and indemnity are ruled by the provisions of Swiss law and we are only liable for gross negligence and intent. This includes our employees or other helping persons. Binding law terms (i.e. law of product liability) are not effected.

(4) Refunds / replacements for items bought as gifts can only be given / sent to the original purchaser. If you decided to change an item, the original purchaser will be informed.

(5) Replacement items will be sent out free of shipping charge.

Art. 11: Secure Transactions

Secure Transactions – Paypal’s e-commerce system uses SSL (Secure Sockets Layer) - the industry standard for encryption technology used to create a secure transaction environment for commerce on the Internet. If your browser and local network support the use of encrypted data transmissions, our Secure Checkout mode locks all information (i.e.: your credit card number) passed from you to Paypal in an encrypted envelope, making it extremely difficult to be intercepted by an unauthorized party.

Art. 12: Privacy Policy

(1) We respect your privacy rights and recognize the importance of protecting the information
collected about you. All your private data is confidential. We will never sell, exchange or market it in any way.

(2) We will only collect personally identifiable information to the extent deemed reasonably
necessary to serve you in view of our legitimate business purposes as set out above,
and we will use our best care to maintain appropriate safeguards to ensure the security,
integrity and privacy of the information you have provided us with.

(3) Once you register an account the first time, you will be automatically included to our newsletter service. We will only send Newsletters when deemed necessary and with reasonable time lag between one and another. You may always immediately unsubscribe from this service starting with the first newsletter you receive.

All rights of trademarks, designs, texts and all other products are under our sole copyright. This website is protected by copyright. Modifications, reproductions or any imitation or copy is forbidden.

Art. 14: Limitation of Liability

(1) While we will use reasonable care to verify the accuracy of any information it places on this webpage, we make no warranties, whether express or implied in relation to its accuracy. This webpage is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to this webpage, or any transaction that may be conducted on or through this webpage.

(2) We make no warranty that this webpage will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that this webpage or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. Art. 15: Designated Court

(1) Subject to mandatory provisions of Swiss or international laws, all terms and contracts under this agreement shall be governed by Swiss Law with jurisdiction of the competent courts of the Canton of Geneva, Switzerland.

(2) Should a provision of these general conditions of supply prove to be wholly or partly invalid, the parties to the contract shall jointly seek an arrangement having a legal and economic effect which will be as similar as possible to the invalid provision.
